DESCRIPTION
The sale offers a rare opportunity, in this location, to purchase several parcels of agricultural and amenity land, strategically located around the villages of Irton and Seamer. Available for sale as a whole or in 5 individual lots ranging from a single grass paddock in Irton village to larger blocks of arable and grassland, the sale offers an opportunity for purchasers with agricultural, amenity and conservation interests, as well as investment purchasers seeking land to promote for development.
The land is generally divided into large fields, well suited to modern farm machinery with good access either from the public road or via excellent stoned access tracks.
Classified as Grade 2 and 3, the land is productive with soil types ranging from clayey, silty and fine loamy soils to free draining, calcareous soils overlying limestone. The land in Lots 1 and 2 benefits from under-drainage installed in the 1980’s.

GENERAL REMARKS AND STIPULATIONS
METHOD OF SALE
The land is for sale by Private Treaty as a whole or in 5 lots. Interested parties should register their interest with Dee Atkinson and Harrison to be kept informed as to how the sale will be concluded. The Vendor reserves the right to complete the sale by any other means at their discretion.

The land is for sale freehold and vacant possession will be provided on completion, subject to any holdover provisions.
SERVICES
Mains water is supplied to the grass field in Lot 5 along with other land and the purchaser(s) will be required to install a new meter or supply within 3 months of the completion date.. No other services to the land exist to our knowledge.
BASIC PAYMENT SCHEME (BPS)
The land is registered and has been used to claim BPS Entitlements. The purchaser(s) will be required to satisfy themselves as to the eligible area for the Basic Payment Scheme. Entitlements relating to the land are included in the sale and will be transferred from the previous occupier following completion.
The Purchaser(s) will be required to provide an indemnity against any breach of cross compliance between the date of completion and the 31st of December 2022.
ACCESS
The land is divided into two main blocks, with Lots 1, 2 and 3 at Irton and Lots 4 and 5 to the east of Seamer village.
Lots 1, 2 and 3 can be accessed off the Main Street through Irton village. An excellent stoned access track (‘Goose Mire Lane’) leads from Irton village through the land included with Lot 1 and is a designated bridleway. The entrance track and gateway leading into Lots 2 and 3 has become over-grown but both are still evident.
The land included with Lots 4 and 5 to the east of Seamer village can be accessed directly from the B1261 and ‘Stoney Haggs Road’. There is also a right of access through neighbouring land to Lot 5.

SEAMER HORSE FAIR
Part of Field NG3636 in Lot 5 is currently used to accommodate travellers attending the Seamer Horse Fair, which generally takes place between 22nd June and 21st July (inclusive) each year.
The purchaser(s) of this field will be required to continue with this arrangement as a condition of the sale. Further details are available upon request.
SPORTING AND MINERAL RIGHTS
Sporting rights are included as far as they are owned.
All minerals and associated rights of extraction are specifically reserved from the sale.
CLAWBACK PROVISION
The land is to be sold subject to a Clawback provision whereby 50% of any uplift in value (net of any costs or charges) created from the grant of any planning consent for non-agricultural use, is to be paid to the vendor. The Overage will operate from the date of completion until the 31st December 2060.
INGOING VALUATION AND HOLDOVER
An ingoing valuation will be payable by the purchaser(s) for any seeds, fertilisers, cultivations, sprays and acts of husbandry applied to the land or undertaken prior to completion, in relation to crops to be harvested in 2023.
A holdover provision will be required for any current crops of fodder beet to the 30th of September 2022 and maize until the 31st of October 2022, to allow for harvesting.
PUBLIC RIGHTS OF WAY, EASEMENTS AND WAYLEAVES
The land is sold with the benefit of all the accustomed or granted rights of way, water, support, drainage, electricity supplies, light, or other easements, or quasi easements and restrictive covenants and all existing or proposed wayleaves for electricity, drainage, water, gas and other pipes whether shown on the plan or indicated in these particulars or not and without any obligations to define the same respectively.
Parts of the land are subject to wayleaves for electricity poles and Lot 1 is also crossed by overhead electricity lines supported by pylons.
Lot 1 is also crossed by a public footpath and a sewer with a manhole in Field NG5286.
There is a right of access over the track through Pt. NG 6386 in Lot 1 in favour of the owner of Derwentdale Farm, with a reciprocal right in favour of the land offered for sale through Derwentdale Farm to East Ayton.
Lot 5 benefits from a right of way (with or without vehicles) and stipulated as ’15 feet wide’, over land adjoining the north boundary, with the approximate route shown coloured green on the plan.
NITRATE VULNERABLE ZONE
Part of the land is within a Nitrate Vulnerable Zone.
CONTAMINATED LAND
The Vendor is not aware of the land having been filled with any contaminated matter referred to in the Environmental Protection Act 1990, but does not give any guarantee in this respect. Purchaser(s) must make their own enquiries and investigations.

BOUNDARIES
Field NG Pt. 6121 in Lot 2 currently forms part of a larger field. The purchaser will be required to erect a new fence along the eastern boundary consisting of pig netting and two strands of wire within two months of completion. The vendor will install marker posts showing where the fence is to be erected.
The eastern boundary to NG Pt.2595 (Lot 4) is currently not defined on the ground and the owner of the land to the east has the right to erect a fence or boundary structure.
VAT
If the sale of the land, any part of it or any right attached to it becomes chargeable for the purposes of VAT, such tax will be payable in addition to the purchase price.
